Wawasakonese ManPower Services Inc. (“WMPS” or “We”) offers recruitment and employer/employee matching services to its users (“You”), specializing in the work forces of growing Northern Ontario industries (the “Services”). We offer our services to employers and to candidates.

Your use of the ‘wmps.ca’ website (the “Website”) constitutes your agreement with the terms and conditions outlined below, with any other terms and conditions stated herein, and with any applicable laws. These terms are subject to change without prior notice.

Geographic Scope

Unless otherwise specified, WMPS offers the services provided by this Website only in Canada. Unless otherwise specified, the site is available for visitors outside Canada only for purposes of information.

Intellectual Property

All content included on the site, including, but not limited to, text, design, graphics, logos, button icons, images, audio clips, digital downloads, interfaces, data compilations, software, and code, is the property of WMPS, its affiliates, or its content suppliers, and is protected by Canada and international copyright.

For any user-created content, you grant WMPS a non-exclusive, revocable, sub-licensable, royalty-free, worldwide licence, to use, reproduce and display this respective Intellectual Property for the purposes of providing the Service and to ensure the proper functioning of the Website.

Site Use

The Website and its content are provided solely for personal, non-commercial use and for no other purpose. Any downloading or copying of the materials herein is permitted for such personal, non-commercial use only. No right, title or interest in such materials is transferred to you upon such copying or downloading, and such materials may not be transferred, linked, reproduced, retransmitted or otherwise distributed or displayed in a manner non-compliant with the above.

You may only use the Website as permitted by law and authorized in this Terms of Use, and in accordance with all other policies contained on the Website. Any illegal or unauthorized use terminates the permission or authorization granted by WMPS to use the Website, and any related site. WMPS retains the right to terminate a user’s permission or authorization to use the site without notice.

To make use of the Services, such as registering for an account, you must be 18 years of age. If you are younger than 18 years of age, you must make use of the site with the consent and supervision of an adult.

User Representation

In making use of the Services, you acknowledge, agree, and represent that you will not attempt to circumvent WMPS’ involvement or its role in the provision of the Services in the recruitment process, or make use of services in competition with WMPS. This right and obligation arises, as an employer, upon posting a position on the Website, and, as a candidate, upon indicating interest in a position, either independently or in response to communications from WMPS.

Disclaimer and Limitations of Liability

THE WMPS WEBSITE SERVICES AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE WEBSITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. Acceptable Use & Prohibited Activity

You must not engage with, make use of, or any in way abuse, the Website, the Services, content, products, software, or other material contained therein, in a way that is in contravention of any laws, or is not explicitly authorized by this policy, or the Terms of Use. Any illegal or unauthorized use terminates the permissions or authorization granted by WMPS to use the Website, and any related site or service. WMPS retains the right to terminate a user’s permission or authorization to use the Website without notice.

Prohibited activity includes the following:

(a) You must not annotate and/or display (i) any material protected by copyright or other intellectual property rights without the prior approval of the respective rights holder, nor (ii) any illegal or otherwise inappropriate or obscene material.

(b) You must not use the Website, or any services provided therein, for any illegal, fraudulent or unauthorized purpose. You agree to comply with all local laws regarding online conduct and acceptable content.

(c) You must not copy any elements of the Website, including the code and the design, the WMPS name, trademark, logo or other proprietary information, without our prior written consent.

(d) You must not attempt to circumvent or breach any security or any authentication measures put in place by WMPS or its service providers.

(e) You must not transmit any worms or viruses, any code of a destructive nature or otherwise interfere with the operation of the Website.

(f) You must not provide WMPS or any other users of the Website any false or misleading information, or the personal information of any other person than yourself.

(g) You must not attempt to replicate or circumvent any of the functionality of the Website with any unauthorized solutions created by you or by a third party.

(h) You must not collect from any third parties personal data or personally identifiable information in violation of any data protection and/or privacy laws.

(i) You must not encourage or solicit any third party to do any acts prohibited by these Terms of Use.

If WMPS becomes aware that a visitor has violated any of the terms and conditions contained in this policy, or other policy or agreement contained on the Website, WMPS may immediately take any corrective action it sees fit. Such measures include preventing the user from using the Website, all or certain parts of the services offered therein, and immediately removing without notice any information, data, or content uploaded by the user. If WMPS is injured by the violation of these terms and conditions, it may, in its sole discretion, seek to recover damages or pursue any other course of action it deems necessary.

Assignment

These Terms of Use will enure to the benefit of and be binding upon WMPS and its successors and assigns, and you and your heirs, executors, administrators, successors, permitted assigns, and personal representatives. You may not assign the Terms of Use or any of your rights or obligations hereunder without WMPS’ prior written consent. WMPS may assign these Terms of Use or any of its rights or obligations hereunder without notice.

Applicable Law and Venue

By using the Website, you agree that the laws of the Province of Ontario, and the laws of Canada applicable therein, shall govern the Terms of Use without giving effect to any conflict of law principles and further agree to attorn to the exclusive jurisdiction of the courts of the Province of Ontario and that the venue for any action, suit, or proceeding arising from or relating to these Terms and Conditions or WMPS products shall be Toronto, Ontario.

For Quebec-based Users: These Terms and Conditions and any dispute of any sort that might arise between you and WMPS shall be governed by the laws of the Province of Quebec, without reference to its conflict of laws provisions, and the laws of Canada applicable therein, and any disputes will be submitted to the courts of competent jurisdiction of the District of Montreal (Quebec).

Modification and Severability

WMPS reserves the right to make changes to our site, policies, and Terms of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
